By law, this form must be presented to the consumer prior to any substantive contact.
Who completes this form? The Broker of Record. Who presents this form? The on-site or tenant-facing staff member for the property management company. Who signs this form? The forms are pre-signed by Broker of Record. The Consumer must be presented with this form prior to any substantive contact. A signature should be requested, but is not required. Process: 1. Download the form. 2. Integrate the form into your local forms package. 3. Personally provide or electronically send it to the tenant to request their signature. Why are these forms required? Agency disclosures are required in almost every state in the country prior to any substantive contact with a consumer. Not providing agency forms to a consumer in a timely manner subjects property management companies to regulatory fines up to $5,000 for every instance in which one should have been presented.
