  • Turf State: An out-of-state licensee is prohibited from performing any licensed services for a real estate transaction in this state without a proper license from this state.
  • An out-of-state licensee can only receive a referral fee from a licensed broker in this state. However, the out-of-state licensee must first obtain a Referral Agent License. A referral is defined as introducing or directing a consumer to a licensee in this state.
  • An out-of-state licensee cannot receive or share in a commission.
  • Case law appears to interpret this state as a physical location state.
